Laurent Le Berre, devenu président de l’Affiliation pour la safety et la promotion de la côte des Légendes (APPCL), comme d’autres militants pour l’environnement, pointe du doigt la responsabilité de l’élevage intensif.
L’éleveur, qui rejette les accusations et se dit ouvert au dialogue, a refusé de répondre à nos questions. « Si vous souhaitez plus de renseignements sur la filière, je vous conseille de vous rapprocher de la chambre d’agriculture », nous a-t-il rétorqué lorsque nous l’avons sollicité en avril dernier pour une rencontre. Depuis, nous lui avons envoyé par courriel à plusieurs reprises une liste de questions, qui sont restées lettre morte.
Des autorités environnementales peu écoutées
Dès 2015, la Mission régionale de l’autorité environnementale (MRAe) critique vivement le projet d’extension porté par Philippe Bizien, dont les conséquences sur les ruisseaux, les zones humides et la qualité de l’air sont à ses yeux « insuffisamment étayé[es] ». L’année suivante, un rapport d’enquête publique se conclut par un avis défavorable au projet pour les mêmes raisons. Le rapport précise que déjà, dans sa dimension existante, les installations de la SARL Avel Vor produisent « des gênes relations à de nombreuses nuisances ».
L’enquête publique est une procédure déclenchée par le préfet lorsqu’une set up industrielle est vulnerable d’affecter l’environnement. « Ça s’appelle la démocratie participative. C’est la dernière likelihood pour les citoyens de faire entendre la raison face à une technocratie trop sûre d’elle », défend Dominique Rémy, magistrat délégué aux enquêtes publiques au tribunal administratif de Rennes.
Quelques mois plus tard, le 29 mars 2016, Michel T., un salarié expérimenté, meurt au sein d’Avel Vor, broyé par la machine servant à fabriquer l’aliment des porcs. En avril 2022, la société sera reconnue coupable d’murder involontaire et Philippe Bizien de négligence concernant la sécurité des salariés. L’exploitant n’a pas fait appel. Interrogée sur ces factors, la préfecture du Finistère, dont la réponse a pris trois semaines, est laconique : « Nous ne communiquons pas sur des dossiers qui font l’objet de procédures devant la justice. »
L’ancien commissaire non renouvelé
Contacté par Splann, Alain Gérault, le commissaire-enquêteur de 2016, réagit à l’autorisation accordée au projet d’agrandissement : « Notre avis n’est que consultatif, la préfecture a le droit de ne pas le suivre. Mais après dix ans de carrière, c’est la première fois que ça m’arrivait. » En sus, il explique n’avoir pas été renouvelé dans sa fonction de commissaire-enquêteur l’année qui a suivi cette enquête.
Aucune explication ne lui a été fournie par la fee départementale d’aptitude. Il se souvient d’avoir ressenti « une forte stress lors de l’enquête publique ». « Des élus municipaux se prononçaient contre le projet et des riverains déclaraient qu’ils allaient engager des recours, raconte-t-il. Quant au maire [Jean Héliès, premier adjoint de 2001 à 2014, puis maire de 2014 à 2020 – ndlr], il n’est jamais venu me saluer. Durant mes précédentes enquêtes, j’ai pourtant toujours été accueilli par le représentant de l’autorité municipale. J’ai compris que j’avais affaire à un file hautement politique, le porteur de projet étant le président du Comité régional porcin, et aussi l’un des plus gros employeurs du village. »
Jean Héliès, contacté par téléphone, reconnaît n’être pas venu voir le commissaire-enquêteur. Selon lui, il n’a simplement pas « été informé par ses companies des horaires de venue en mairie du commissaire ». Favorable au projet d’extension, il raconte avoir convié le sous-préfet à visiter Avel Vor, ce qui leur a permis de constater ensemble que « l’usine est très bien équipée et ne rejette rien dans la rivière ».
Alain Gérault disparaît donc du paysage des commissaires-enquêteurs bretons en 2016, tandis que l’extension d’Avel Vor est réalisée la même année.
Des jugements sans effet
Eau et rivières de Bretagne et l’affiliation Avenir et environnement en Pays d’Iroise (AEPI) forment aussitôt un recours contre l’arrêté préfectoral d’autorisation. Elles sont rejointes par l’APPCL de Laurent Le Berre.
Le tribunal administratif de Rennes, en 2019, tranche en leur faveur. Étant donné « les omissions affectant l’étude d’impression » du file proposé par la SARL Avel Vor, l’arrêté du préfet est annulé. La cour d’appel de Nantes confirme ce jugement en 2021.
Le préfet Philippe Mahé accorde malgré tout une autorisation provisoire à Avel Vor, assortie de circumstances dont la soumission d’une nouvelle demande d’autorisation. Une deuxième enquête publique, étape nécessaire à la régularisation de la porcherie, est donc organisée début 2022.
« Vous avez vu qui est le pétitionnaire [Philippe Bizien, ndlr] ? Il a tout de même une superficie politico-sociale importante », réagit Dominique Rémy, qui avait appelé le tribunal administratif à annuler l’arrêté, en tant que rapporteur public. « De toute façon, en matière d’ICPE agricoles [installations classées pour l’environnement – ndlr], les préfets ont du mal à rendre des avis défavorables, automobile derrière il y a l’économie agricole », glisse-t-il.
Le vendredi 1er avril 2022, masques sur le nez, regards tournés vers l’écran, une soixantaine de Landunvéziens sont réunis dans la salle du Triskell. Les associations environnementales, sorties victorieuses des recours administratifs, ont pris l’initiative de cette réunion. Elles déclarent craindre un avis partial du commissaire-enquêteur, Jacques Soubigou, officier de gendarmerie à la retraite, chargé de mener la seconde enquête publique.
En 2012, à l’situation de son enquête sur le projet de centre de formation du Stade brestois, il n’a pas mentionné la présence d’une espèce protégée sur le web site. Quelques années plus tard, il contribue à un rapport d’enquête publique donnant un avis favorable au très contesté projet de centrale à gaz de Landivisiau, en ignorant des avis critiques. Plus récemment, Jacques Soubigou a également approuvé l’extension d’une porcherie membre du groupement de producteurs dirigé par Philippe Bizien, à Plouarzel, malgré un avis défavorable du Parc naturel marin d’Iroise.
Pourquoi a-t-il été choisi pour mener l’enquête publique sur le file Avel Vor ? Le magistrat Dominique Rémy explique qu’il n’y a aucune raison précise : « On a un vivier de commissaires-enquêteurs dans lequel on puise de façon aléatoire, afin que tout le monde fasse deux ou trois enquêtes par an. On prend aussi en compte la proximité géographique. »
Concernant le file de Jacques Soubigou, « je ne dirai pas ce que j’en ai pensé », commente-t-il, confiant toutefois vouloir faire « la chasse aux anciens gendarmes et aux anciens de la DDE [Direction départementale de l’équipement]. Ils ne sont pas assez critiques, ils ont trop de difficultés à rompre avec leur administration d’origine ». Pourtant, contrairement à Alain Gérault, Jacques Soubigou est renouvelé dans ses fonctions de commissaire-enquêteur depuis plus de 10 ans.
La dimension politique du file, absente
C’est le 28 mai 2022 que Jacques Soubigou remet ses conclusions sur l’extension d’Avel Vor au préfet Philippe Mahé. Son rapport montre que la fréquentation du public est allée crescendo au fil des cinq demi-journées de sa permanence. Le dernier jour, quatre personnes ont même dû être reçues simultanément. D’après les associations, d’autres ont quitté la file, « lasses d’attendre dans une ambiance tendue, debout devant le sas ».
Pourtant, Jacques Soubigou estime qu’avec 31 visites, 259 mails et une pétition de 3 298 signatures, « la inhabitants locale s’est moyennement intéressée au projet soumis à l’enquête ». Dominique Rémy, délégué aux enquêtes publiques depuis 2011 au tribunal administratif de Rennes, donne un tout autre aperçu de la réalité : « Dans la grande majorité des enquêtes publiques en Bretagne, il y a très peu d’observations du public, même pas dix par file. »
Le commissaire-enquêteur omet de mentionner la réunion publique du 1er avril, qui a réuni soixante personnes, ainsi que les avis déposés par deux élues. Nous avons pu vérifier que la conseillère communautaire de Pays d’Iroise Communauté, Armelle Jaouen, et la maire de Lanrivoaré, Pascale André, ont chacune signé une contribution en précisant leur fonction. La première contre la régularisation et la seconde en sa faveur. Pourtant, Jacques Soubigou indique dans ses conclusions qu’« aucun élu ou groupe politique » n’a pris half à la session.

Sur le fond du file, la remise en trigger du consensus scientifique sur l’origine agricole des marées vertes jette le bother sur les intentions ou les connaissances du commissaire. « Les problèmes de air pollution (algues vertes) qui sont constatés sur le littoral immédiat peuvent être rapprochés également des problèmes du traitement des eaux usées de l’habitant… Problème en cours de résolution, signifié par les élus », écrit-il.
Or ce discours est exactement celui tenu jusque dans les années 2010 par les companies de communication du secteur agro-industriel pour semer le doute sur la responsabilité écrasante de l’élevage intensif ; discours vivement critiqué dans un rapport interministériel en 2012.
Ces propos font rire jaune Laurent Le Berre. Le président de l’APPCL souligne que la plupart des eaux de Landunvez sont traitées par une station d’épuration située à Porspoder, dont l’éventuel trop-plein ne s’écoule pas dans le bassin-versant atteignant les plages de Landunvez.
Le commissaire-enquêteur a au moins le mérite de la constance. Son commentaire laconique et peu renseigné est un copier-coller de la conclusion de son enquête sur l’extension du Gaec de Kerascot, à Plouarzel. Interrogé sur ces factors par Splann, le commissaire-enquêteur n’a pas souhaité livrer son level de vue.
Les effets de cumul, l’élément clé balayé
D’autres carences pointées par l’Autorité environnementale souffrent d’un manque flagrant de réponse. Au sujet des émissions d’ammoniac, la MRAe relève en 2021 que « le risque d’effet cumulé avec les élevages voisins ne peut raisonnablement pas être évalué comme faible, contrairement à ce qui est indiqué dans le file [produit par l’éleveur] ».
Tout porteur de projet doit en effet prendre en compte la densité d’élevages sur son territoire. Elles augmentent le risque de maladies respiratoires chez ceux qui les respirent.
Gaz précurseur de particules très fines (PM 2.5), l’ammoniac émis par les élevages bretons se mix aussi avec des poussières pour former des particules fines, responsables de 48 000 morts prématurées dans l’Hexagone, chaque année, selon Santé publique France.
Or la porcherie de Philippe Bizien trône au cœur d’une véritable ceinture du cochon. Landunvez et les trois communes limitrophes comptent à elles seules 22 élevages pour plus de 56 000 animaux équivalents, au sein d’un territoire, le Finistère, dont la focus d’élevages porcins est l’une des plus importantes d’Europe.
Un état de fait préoccupant balayé en trois lignes par Jacques Soubigou. « Il n’y a pas de projet en cours dans le rayon d’affichage, écrit le commissaire-enquêteur. Le projet […] n’a pas d’impression cumulé avec d’autres projets et les éléments nécessaires à déterminer d’éventuels effets cumulés avec les élevages environnants déjà existants ne sont pas communiqués ou communicables… »
Une affirmation étonnante puisque les émissions d’ammoniac déclarées par les grands élevages de porcs sont en accès libre sur Web, comme l’avait montré l’enquête de Splann publiée en juin 2021. Not possible d’obtenir des explications auprès de Jacques Soubigou, qui, par téléphone, nous a simplement dit : « Écrivez ce que vous voulez », avant de raccrocher.
Finalement, le commissaire émet une réserve. Il demande le rehaussement d’un talus, afin d’éviter tout risque d’accident en cas d’écoulement des cuves à lisier. Travaux que le porteur de projet s’est engagé à réaliser « au plus tard avant la fin de l’année 2022 ».
Déni de démocratie environnementale
Malgré ces différents biais, l’avis favorable de Jacques Soubigou prépare le terrain à la régularisation du projet.
Avant d’atterrir sur le bureau du préfet du Finistère, le file sera prochainement présenté dans une occasion peu connue : le Coderst (comité départemental de l’environnement et des risques sanitaires et technologiques). Il comprend 26 membres, dont sept représentants des companies de l’État, trois représentants des filières concernées (on y trouve par exemple Dominique Ciccone, directeur général du géant de l’agroalimentaire Eureden), cinq élus, et seulement trois associations.
Parmi les élus, Splann a pu constater qu’au moins la moitié travaillait pour le secteur agro-industriel. Gilles Mounier, vice-président du conseil départemental du Finistère, était cadre à Evel’Up (poste qu’il a quitté récemment), la coopérative porcine présidée par Philippe Bizien. Sa déclaration à la Haute Autorité pour la transparence de la vie publique (HATVP) nous apprend en outre que son épouse y est aujourd’hui salariée, chargée de la communication. Son remplaçant n’est autre que le maire de Landunvez, Christophe Colin, lui aussi cadre de l’agroalimentaire chez Tromelin Vitamin. Enfin, Marie-Christine Lainez est conseillère départementale et gérante d’exploitation porcine sur la commune de Plourin, limitrophe de Landunvez.
Avec un tel casting, peu de doutes subsistent sur le vote favorable du Coderst au projet d’extension d’Avel Vor, qui ouvrira la voie au sésame délivré par le préfet. Ultime étape achevant de mettre en évidence l’impuissance des contre-pouvoirs légaux et de la démocratie environnementale locale dans ce file. La justice condamne, l’enquête publique est fallacieuse, mais la préfecture peut malgré tout régulariser.
« C’est un parcours kafkaïen pour les défenseurs de l’environnement », se désole le juriste Brieuc Le Roch, qui se prépare à déposer un nouveau recours en cas de régularisation au nom d’Eau et rivières de Bretagne. Même s’il sait qu’en cas de jugement en faveur des associations, rien n’empêchera le préfet de prendre un énième arrêté préfectoral d’autorisation.
Le cas de Landunvez ne paraît pas isolé, comme le montre notre carte interactive, pourtant loin d’être exhaustive. Bien d’autres grands projets agricoles et agroalimentaires finissent par obtenir les autorisations nécessaires, en dépit d’enquêtes bâclées, d’avis défavorables et même d’annulations devant les tribunaux.

« Les recours en justice sont importants automobile ils légitiment le fight du côté de la légalité, mais la mobilisation est décisive, appuie l’universitaire. Les projets ne se font pas quand les banques ne suivent plus le porteur de projet. Cela arrive quand les travaux sont ralentis, et qu’il risque de ne pas pouvoir lancer son plan d’exploitation comme prévu. Il faut un croisement des luttes. La lutte juridique n’est complète que si, localement, il y a un engagement des populations, et qu’elles disent “on ne laissera pas faire”. »
